The account
The person who signs up becomes the admin of a company workspace. The admin sets the buyer profile, invites colleagues and decides what they may do. Employees work inside that profile; they do not change it.
You are responsible for what happens under your account, including anything your colleagues do with it. Keep the credentials to yourself and tell us promptly if you think somebody else has them.
What we provide
Software that identifies companies matching a profile you define, checks their published business contact details, and sends outreach on your behalf through a mailbox you connect.
We aim to keep the service available and correct, and we tell you plainly when something is uncertain. We do not promise uninterrupted service, and we do not promise any commercial result. Nobody honest can promise you replies.
What you are responsible for
You decide who to contact and what to say. That makes you responsible for your outreach under the marketing and data protection laws that apply to you and to the person receiving it. Those rules differ by country, and they are stricter in some places than others.
- Only contact people where you have a lawful basis to do so.
- Say who you are and give a genuine way to opt out.
- Stop contacting anybody who asks you to, promptly and permanently.
- Do not use the service for anything unlawful, deceptive or harassing.
The acceptable use policy sets out the detail, and it forms part of these terms.
Your data and ours
Your prospects, campaigns, messages and replies belong to you. You can export them at any time, and you can ask us to delete them when you leave.
The software, its design and the way it works belong to us. Using the service does not transfer any of that to you, and you may not copy, resell or reverse engineer it.
We may use anonymous, aggregate statistics about how the product is used to improve it. That never includes your prospects, your messages or anything identifying your company.
Mailboxes you connect
When you connect a mailbox you authorise us to send and read mail on your behalf, strictly to operate the features you are using. You can disconnect it at any time, which stops both immediately.
Your sending reputation is yours. We pace outbound mail and respect the daily limit you set, but a mailbox is only as safe as the list it writes to and the words it sends, and both of those are yours.
Suspension
We may suspend an account that is being used to break the law, to harass people, or in a way that endangers the service for other customers. Where we reasonably can, we will warn you first and give you a chance to put it right. Where the harm is ongoing, we will act first and explain afterwards.
Ending the agreement
You can close your account at any time. We can end this agreement with reasonable notice, or immediately if the terms are seriously breached. On closure you keep the right to export your data for 30 days, after which it is deleted.
Liability
The service is provided as it is. To the extent the law allows, we are not liable for lost profits, lost business or indirect loss, and our total liability is limited to the fees you paid in the twelve months before the claim.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Changes
We may change these terms. If a change materially affects you we will give notice before it takes effect, and continuing to use the service after that means you accept it.
